This Terms of Use and the Privacy Notice apply exclusively to the Caren platform.

By registering and using the services, you confirm that you have read and understood the Terms of Use and Privacy Notice applicable to the service and agree to be bound by them.

DESCRIPTION OF SERVICES:

Caren is an innovative telehealth solution that can offer an extensive range of services, including teleconsultation in medicine, psychology, nutrition, speech therapy, nursing, among others. With information and communication technology as a basis, it allows patients to easily connect with Health Professionals of various specialties. This remote connection enables pre-clinical care, care support, consultations, monitoring and diagnosis, ensuring convenience, accessibility and quality in the healthcare provided. Caren is only the platform on which the telehealth service is provided by the healthcare professional, and has no responsibility for the consultation and services provided by the professional.

GLOSSARY:

Caren is an electronic tool designed to facilitate the practice of telehealth between Patients and Healthcare Professionals, who are the professionals that contract the Platform to provide the solution to their patients and clients, and the Platform may be referred to as just the Platform. Caren encompasses a variety of features including software, website, applications and other elements to provide a secure and efficient virtual space.

Patients, so called users who wish to use Caren, must be over 18 years old and agree to our Terms of Use and policies. In addition, the so-called Dependents, who are individuals legally dependent on the Patients, may be incapacitated or relatively incapacitated.

USERS' RIGHTS:

Right to privacy: Users have the right to have their personal data and sensitive information protected in accordance with Caren's privacy policies. The platform adopts security measures to ensure the confidentiality and proper use of the information shared.

Right to transparency: Users have the right to receive clear and transparent information about the services offered by Caren, including payment policies, terms of use and any fees or charges involved in using the platform.

Right to security: Caren strives to ensure a secure environment for users. The platform implements security measures to protect users' personal data and information as well as to prevent fraudulent activities.

Right to support and customer service: Caren is committed to providing support and customer service to users in an efficient manner to address their needs and queries. The platform provides communication channels to assist users in their interactions and resolve any issues.

USER RESPONSIBILITIES:

Proper use: Caren users are responsible for using the platform appropriately by complying with the applicable terms of use, policies and regulations. This includes providing accurate, up-to-date and complete information when registering on the platform, as well as ensuring that the activities carried out comply with applicable laws.

Ethical conduct: Users must act ethically, respecting the rights and privacy of other users, patients and third party professionals involved. This implies not using the platform for illegal, defamatory, discriminatory, fraudulent or harmful activities.

Clear and Respectful Communication: Users are responsible for maintaining clear and respectful communication. This includes providing relevant information accurately, responding promptly to messages, and treating others with courtesy and respect.

Payments and Financial Arrangements: Users are responsible for making the agreed payments for the contracted services within the established deadlines. It is also important to ensure that the payment information provided is accurate and up-to-date.

Security and Data Protection: Users must take the necessary steps to protect their account access information, passwords and personal data. It is the responsibility of users to keep this information confidential and to notify Caren immediately if they suspect any unauthorized activity on their accounts.

It is essential that users understand and take on these responsibilities when using the Caren platform, as they contribute to a safe, reliable and productive environment for all involved.

CAREN'S RESPONSIBILITIES:

Service Provision: Caren is responsible for providing a telehealth platform between healthcare professionals and patients. This includes providing the technological platform, resources and tools necessary to carry out the consultations.

Verification of Healthcare Professionals: Caren has the responsibility to perform a basic verification of healthcare professionals who register on the platform in order to ensure that their information is authentic. However, it is important to note that Caren cannot guarantee the quality, experience or capacity of healthcare professionals, and it is the responsibility of patients to evaluate and select the most appropriate professionals for their needs.

Data Protection: Caren undertakes to take reasonable steps to protect the data and information provided by users in accordance with applicable data protection laws. The company also undertakes not to share users' personal information without proper consent, except where required by law.

User Support: Caren strives to provide support and assistance to users regarding the use of the platform, clarifying doubts and solving technical problems. User support can be carried out through communication channels designated by Caren, such as email or chat.

Platform Security: Caren is responsible for taking appropriate security measures to protect the Platform from unauthorized access, cyber attacks or other threats. However, users must also take responsibility for protecting their access information and taking security precautions when using the Platform.

Continuous Improvement: Caren is committed to constantly strive for the improvement of the platform, taking into account user feedback and implementing updates and enhancements that can benefit the user experience.

INTELLECTUAL PROPERTY

Copyright: All content and materials present on the Platform, including texts, images, graphics, logos, icons, audios, videos, software and any other element, are protected by copyright. These rights belong to Caren or to third parties who have authorized their use by the company.

Restricted Use: You are prohibited from copying, reproducing, modifying, distributing, transmitting, displaying, publishing, selling, licensing or exploiting any content on the Caren Platform without the prior written permission of the company or the copyright holder.

Reporting Infringement: If users identify any content on the Caren Platform that infringes their intellectual property rights, they may contact the company to report the infringement. Caren commits to investigate the reports and, if appropriate, take appropriate action, such as removing the infringing content.

Caren recognizes the importance of intellectual property protection and is committed to respecting the copyright and other intellectual property rights of others. Users must act responsibly and ethically by ensuring that the content they share does not infringe these rights.

REGISTRATION OF USERS:

Caren makes its services available to both individuals and legal entities that are duly registered with the competent bodies and have the legal capacity to contract such services. It is important to note that individuals who do not have this capacity, including minors and persons who have been disabled by Caren, temporarily or permanently, are not authorized to use the services. Users should be aware that civil law provides sanctions for non-compliance with these conditions.

To ensure the integrity of the system, the creation of more than one registration per User is expressly prohibited. If the existence of multiple registrations associated with a single User is identified, Caren reserves the right, at its sole discretion and without prior notice, to disable all existing registrations and prevent new registrations related to this information.

Please note that only one registration per CPF/CNPJ, telephone number or e-mail address may be linked. Thus, duplicate data is strictly prohibited under any circumstances.

Caren reserves the right, at its sole discretion, to exclude the registration of Users if it is found that the User's conduct is or will be harmful or offensive to other Users, Caren, its employees or third parties. This measure aims to ensure a safe and respectful environment for all involved in the platform.

Caren may carry out verifications of the functional records of health professionals in their respective class entities, but does not guarantee the accuracy or veracity of the information provided by them. Users agree to release Caren from any liability arising from the professional services contracted through the platform. Caren reserves the right to veto the use of the platform in cases of non-payment of services by health professionals.

Platform Registration: To register as a User on Caren's platform, you must complete a registration form providing accurate and up-to-date information. The User is responsible for ensuring the accuracy and completeness of the data provided.

Profile Creation: After registration, Users will be able to create a profile on the platform, providing relevant identification and qualification information.

Identity Verification: Caren may request the healthcare professional to prove his/her identity by sending valid official documents. This verification is done in order to ensure the security and reliability of the platform.

User Responsibility: By registering on the platform, the User agrees to comply with all obligations and responsibilities set forth in Caren's Terms of Use, as well as applicable laws, rules and regulations.

PAYMENT SYSTEM:

At Caren, the platform's remuneration process is carried out exclusively by health professionals, who must choose the plan that best suits their needs when registering on the platform. The payment and validity rules will be presented at the time of contracting and will be valid until the end of the relationship.

In addition, Caren uses the outsourced payment platform to facilitate financial transactions.

Caren can offer several payment options within its platform, such as payment by credit card, Pix and other modalities. However, it is important to note that Caren reserves the right to modify, add or reduce the payment mechanisms available, always aiming at improvements and adaptations to the needs of users and market requirements.

PROHIBITIONS:

It is expressly prohibited to reproduce, duplicate, copy, sell, resell or commercially exploit Caren content without the prior written consent of the Platform owners. In addition, the use of data mining techniques, robots or other data gathering and extraction tools for the purpose of extracting, on a stand-alone or recurring basis, any significant portion of Caren for re-use is strictly prohibited. Users are aware and agree that violation of these restrictions may result in legal action and liability for damages.

RELATIONS WITH THIRD PARTIES:

Caren may provide links to other websites, however, this does not mean that these websites are owned or operated by Caren.

Because Caren has no control over these sites, Caren is not responsible for the content, practices, and services offered by these sites.

The presence of links to other websites does not imply a relationship of partnership, supervision, complicity or solidarity on the part of Caren with those websites and their content.

PENALTIES:

Caren reserves the right to suspend, for an indefinite period of time, any account that is deemed necessary to maintain the security and integrity of the platform, if this represents a violation of users' rights.

AVAILABILITY:

 The Platform is available for use by the User on an "as is" and "as available" basis.

Caren disclaims implied warranties of merchantability, fitness for a particular purpose and financial return. Furthermore, it does not warrant that the Platform services will be provided without interruption or error.

Users acknowledge that they assume all risk arising from the use of our Platform, being their sole responsibility.

PLATFORM INTERRUPTIONS: 

Access to the Platform may be interrupted, suspended or temporarily intermittent, without notice, due to system or server failures, maintenance, changes in systems or for reasons beyond Caren's control, without any compensation or redress.

CHANGES AND DISCONTINUITY:

‍Caren reserves the right at any time and at its sole discretion, in accordance with its commercial availability, to change any aspect of the Platform, including its features or functionality.

Likewise, Caren may suspend, cancel or discontinue the Platform, in whole or in part, temporarily or permanently, by giving notice to users.

Such modifications shall not constitute a breach of this Term, nor shall they entitle Users to compensation or a fine, except for the obligation to reimburse any amounts paid in advance.

PERSONAL DATA:

To ensure the quality of the Platform and to enable users to obtain results quickly and safely, it is necessary to provide personal data as set out in the Privacy Notice.

MODIFICATIONS:

Caren reserves the right to modify the Terms and Conditions of Use at any time, as well as to change the appearance or operation of the Platform, without any obligation to users. These modifications will take effect immediately after they are communicated by email or made available on the Internet, except when the updates to the Terms and Conditions of Use provide otherwise.

It is understood that the user accepts the changes to the Terms if he/she does not express otherwise or continues to access the Platform normally.

NULLITIES:

If any provision hereof is held to be illegal, invalid or unenforceable, in whole or in part, that portion shall be deemed not to form part of the Terms and Conditions of Use, without affecting the legality, validity and enforceability of the remaining provisions.

Duration The Terms of Use will come into force for each Caren user from the first access to the Platform and will remain in force until the respective registration is deactivated, maintaining the responsibilities during the period of use.

CONFLICT RESOLUTION:

These Terms and Conditions of Use are subject to Brazilian law and any dispute arising from them will be resolved in the jurisdiction of the District of São Paulo/SP, which is considered competent to settle any disputes, to the detriment of any other jurisdiction, however privileged it may be or may become. Whenever possible, priority will be given to attempts at resolution through conciliation or mediation.
